1. Agreement
By accessing Toursby or creating an account, you agree to these Terms and our Privacy policy. If you do not agree, do not use the platform.
2. The Toursby service
Toursby provides an online marketplace and escrow payment layer. We facilitate discovery, booking, messaging, and protected payments between travelers and independent partner guides or agencies. Toursby does not operate tours itself. Partners are independent service providers responsible for delivering the experience described in their listing.
3. Accounts
- You must provide accurate registration information and keep your account secure.
- Travelers must be at least 18 years old or book with guardian consent where required by law.
- Partners must complete verification (identity review and interview for guides) before listing tours or receiving payouts.
- We may suspend or terminate accounts that violate these Terms or pose a safety or fraud risk.
4. Bookings and payments
- Prices, inclusions, and meeting points are set by partners and shown on each tour listing.
- Payments are collected through Toursby escrow. Funds are held until the partner confirms and completes the trip according to platform rules.
- Accepted payment methods may include bank transfer, Midtrans, and Xendit depending on availability.
- A platform service fee (commission) is included in the checkout total and disclosed before payment.
5. Cancellations and refunds
Refund eligibility depends on the cancellation policy attached to each tour (Flexible, Moderate, or Strict) and how close the departure date is. See our Cancellation policy for details. Partner-initiated cancellations may result in a full refund to the traveler.
6. Partner obligations
- Provide accurate tour descriptions, pricing, and availability.
- Confirm bookings promptly after payment is verified and held in escrow.
- Deliver the tour safely, professionally, and in line with local laws.
- Follow the Partner payout policy for withdrawals.
7. Disputes
Travelers and partners may open a dispute for paid bookings. Escrow funds may be frozen while Toursby reviews evidence from both parties. Our decision on refunds or release is binding for platform payment purposes but does not limit rights you may have under applicable consumer law.
8. Limitation of liability
To the maximum extent permitted by law, Toursby is not liable for indirect, incidental, or consequential damages arising from partner conduct, third-party services, force majeure, or events outside our reasonable control. Our total liability for any claim relating to a booking is limited to the fees paid to Toursby for that booking.
9. Changes
We may update these Terms. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance.
